This article by Michael Jones (Kirkland & Ellis, LLP) discusses his use of a title for his opening statement (a more exciting derivative of a theme, I think) and how he wove it into the opening statement and the rest of the trial to compel the jurors to listen.He also discusses how a jury is nothing more than another audience to speak to (albeit one that is forced to make a decision once the presentations are concluded) and gives some insights into speaking with jurors from his experiences speaking in churches.
