One of your roles in trial is that of the professional communicator. You are charged with the responsibility of ensuring that jurors understand what you're talking about. If you can't clearly communicate your thoughts and ideas, it is unlikely that you will be able to convince the jury to decide in favor of your client.

 

An effective method of getting your ideas across involves the use of diagrams or images. In this book, David Macauley shows you how hundreds of devices work. With a combination of words and images, he makes difficult concepts easy to understand. Need a quick overview of how a breathalyzer detects the concentration of alcohol in a person's breath? First, you will tell your client's story more effectively once you understand how the devices involved worked (or failed to work). Reading through this book will give you a quick overview of how the object worked, without having to spend time with an expert witness or doing research at the library. Often, all you need is a basic overview of how the process works before you can proceed - this book will give you that overview.

 

Second, and more importantly, examine how he describes the way things work. In trial, you must ensure that the jurors understand how things work or failed to work. Often, they don't have any experience in these areas (ex. breathalyzers, medical testing devices, products liability issues). Your job will be to teach them about the process or product.
 
The New Way Things WorkExamine how Macauley uses simple diagrams to teach you how various objects work. Notice how simple the diagrams are and how easy the language is to understand? Even your kids will understand how a clutch works or the basic principles of magnetism. Can you add that presentation style to your expert's testimony? Can you add photos, images, or diagrams to his testimony to help your jurors understand?

 

You won't need to refer to this book for every case you try, but on those occasions when you need to understand how something works, or need to show your jurors how something works, you will be glad that this book is within arm's reach.
